1. Acceptance of Terms
These Terms and Conditions (“Terms”) govern your access to and use of the Twendetribe mobile application and website at api.twendetribe.africa and twendetribe.africa (collectively, the “Platform”), operated by Twendetribe (“we”, “our”, or “us”).
By creating an account, downloading the app, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
2. Who May Use Twendetribe
You may use Twendetribe only if you:
- Are at least 16 years old (or the minimum legal age in your country if higher).
- Have the legal capacity to enter into a binding agreement.
- Are not barred from using the Platform under the laws of Kenya or any other applicable jurisdiction.
- Provide accurate, current, and complete registration information.
If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
3. Your Account
3.1 Registration
You must register with a valid email address and mobile phone number. You may also register via Google Sign-In.
3.2 Account security
You are responsible for keeping your password and any authentication tokens confidential. You must notify us immediately at support@twendetribe.africa if you suspect unauthorised access to your account. We are not liable for any loss resulting from unauthorised use of your account before you notify us.
3.3 One account per person
Each person may maintain only one active account. Creating multiple accounts to circumvent restrictions or bans is prohibited.
3.4 Account accuracy
You agree to keep your account information (name, phone number, email) accurate and up to date. Providing false information may result in suspension.
4. How the Platform Works
Twendetribe allows users to:
- Create trips — set a destination, dates, cost breakdown, itinerary, packing list, and other details.
- Invite members — share an invite link or add members by phone number.
- Track contributions — record payments made by members toward shared trip costs.
- Share memories — upload photos, write journal entries, and chat within the trip group.
- Discover trips — join open trips organised by other users.
- Create circles — form recurring travel groups with shared history.
The Platform provides tools to help groups self-organise and communicate. Twendetribe is not a party to any agreement between trip members and is not responsible for the quality, safety, legality, or fulfilment of any trip.
5. Organiser Responsibilities
If you create a trip as an organiser, you agree to:
- Provide accurate information about the trip, including destination, dates, inclusions, exclusions, pricing, and any suitability requirements (minimum age, fitness level, etc.).
- Promptly update trip details if plans change and notify members of material changes.
- Use collected funds solely for the stated trip expenses.
- Process refunds fairly and in accordance with the cancellation policy you have published on the trip.
- Not misrepresent the trip, inflate costs, or retain undisclosed profit margins from funds collected via Twendetribe.
- Ensure any third-party suppliers (hotels, tour operators, transport providers) are legitimate and capable of delivering the services advertised.
- Comply with all applicable laws, including consumer protection laws, when acting as a trip organiser.
Twendetribe may suspend or remove a trip if we receive credible reports of fraud, misrepresentation, or unsafe practices.
6. Member Responsibilities
As a trip member, you agree to:
- Contribute the agreed amount toward trip costs by the payment deadline set by the organiser.
- Communicate promptly with the organiser if you are unable to participate or pay.
- Respect other members and the shared group space (photos, chat, journal).
- Not upload, share, or post content that violates Section 10 (Prohibited Conduct).
- Verify the legitimacy and suitability of a trip before joining and making payment.
7. Payments & the Non-Custodial Model
7.1 Non-custodial
Twendetribe does not hold, process, transfer, or escrow money. Trip contributions are made by members directly to the organiser. Twendetribe records amounts and payment references to display cost-split information — it does not intermediate or guarantee any payment.
7.2 Payment disputes
Any dispute over a payment must be resolved between the parties involved (the member, the organiser, and the payment provider). Twendetribe cannot reverse, block, or refund those transactions. We will, however, provide transaction records available on the Platform to assist in resolving disputes.
7.3 Refunds
Refunds are the sole responsibility of the trip organiser. Each organiser must publish a cancellation and refund policy on their trip before accepting contributions. Twendetribe does not guarantee that refunds will be processed. If an organiser fails to refund members after a cancelled trip, your recourse is against the organiser directly, and potentially through the payment provider’s dispute channels or applicable consumer-protection law.
7.4 Payment providers
Where you pay with a third-party service such as M-Pesa, that payment is governed by the provider’s own terms. Twendetribe is not an agent of those providers and is not responsible for their outages, errors, or charges.
8. Fees
Twendetribe is currently free to use. We reserve the right to introduce fees in the future. We will give you at least 30 days’ notice before any fees apply to features you are currently using. Your continued use of those features after the notice period constitutes acceptance of the new fees.
9. User Content
9.1 Your content, your responsibility
You retain ownership of photos, journal entries, chat messages, trip descriptions, and other content you submit (“User Content”). By submitting User Content, you grant Twendetribe a worldwide, non-exclusive, royalty-free licence to store, display, and transmit that content within the Platform solely to operate the service. We will not use your content in advertising or for any purpose beyond operating the Platform.
9.2 Content standards
You must not submit User Content that:
- Is unlawful, defamatory, obscene, pornographic, or threatening.
- Harasses, bullies, or discriminates against any person or group.
- Infringes the intellectual property rights of any third party.
- Contains viruses, malware, or other harmful code.
- Violates the privacy of any person (e.g. sharing personal data without consent).
- Promotes fraudulent, misleading, or illegal activities.
9.3 Content removal
We reserve the right to remove any User Content that violates these Terms or that we determine in our sole discretion to be harmful to the Platform or its users. We will endeavour to notify you of removals unless doing so would be unlawful or counterproductive.

10. Prohibited Conduct
You must not:
- Use the Platform for any unlawful purpose or in violation of any applicable law.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Collect personal information of other users without their consent.
- Use automated scripts, bots, scrapers, or other tools to access the Platform without our written permission.
- Attempt to gain unauthorised access to any part of the Platform, its servers, or any account other than your own.
- Interfere with or disrupt the integrity or performance of the Platform.
- Circumvent any security, rate-limiting, or access-control mechanism.
- Use the Platform to send unsolicited commercial communications (spam).
- Create trips for the purpose of collecting money fraudulently.
- Reverse-engineer, decompile, or disassemble any part of the Platform.
Violations may result in immediate account suspension and, where appropriate, reporting to law enforcement.
11. Circles
Circles are recurring travel groups within Twendetribe. Circle owners and admins are responsible for managing membership and ensuring the circle is used in accordance with these Terms. Twendetribe is not responsible for the activities or conduct of any circle or its members.
Circle owners must not use circle membership data (names, phone numbers) for any purpose other than organising Twendetribe trips.
12. Intellectual Property
All software, design, trademarks, logos, and content owned by Twendetribe (excluding User Content) are our exclusive property or are licensed to us. You may not copy, distribute, modify, or create derivative works of any Platform content without our prior written consent.
“Twendetribe” and the Twendetribe logo are trademarks of Twendetribe. Nothing in these Terms grants you a right to use our trademarks.
13. Third-Party Services
The Platform integrates with third-party services including Google Firebase, Google Sign-In, Safaricom M-Pesa, and Zoho Mail. Your use of these services is subject to their own terms and privacy policies. Twendetribe is not responsible for the practices or content of any third-party service.
The Platform may contain links to external websites. These links are provided for convenience only; we do not endorse or assume responsibility for external sites.
14. Disclaimers
We do not warrant that:
- The Platform will be uninterrupted, error-free, or secure at all times.
- Any trip listed on the Platform will be safe, legal, accurately described, or successfully completed.
- Trip organisers are qualified, licensed, or trustworthy.
- Any third-party service (including payment providers) will function without interruption.
You use the Platform and participate in trips at your own risk. Travel involves inherent risks including injury, illness, property loss, and death. You are responsible for obtaining appropriate travel insurance.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Twendetribe, its directors, employees, agents, and licensors shall not be liable for any:
- Indirect, incidental, special, consequential, or punitive damages.
- Loss of profits, revenue, data, goodwill, or business.
- Personal injury or property damage arising from your use of the Platform or participation in a trip.
- Losses resulting from unauthorised access to your account.
- Losses resulting from a trip organiser’s failure to deliver a trip or issue a refund.
- Losses resulting from payment-provider outages or transaction errors.
In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability shall be limited to the fullest extent permitted by law. Our total aggregate liability for any claim shall not exceed KES 5,000 or the amount you paid to Twendetribe in the 12 months preceding the claim, whichever is greater.
16. Indemnification
You agree to indemnify, defend, and hold harmless Twendetribe and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third party’s rights.
17. Suspension & Termination
17.1 By Twendetribe
We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or pose a risk to the Platform or other users. Where possible, we will notify you of the reason and give you an opportunity to respond before permanent termination.
17.2 By you
You may delete your account at any time from within the app or by emailing support@twendetribe.africa. Deletion does not release you from any obligations that arose before the deletion (e.g. unpaid trip contributions).
17.3 Effect of termination
On termination, your right to access the Platform ceases immediately. Sections 9.1, 12, 14, 15, 16, 18, and 19 survive termination.
18. Dispute Resolution
18.1 Between users
Disputes between trip members or between members and organisers must be resolved between the parties. Twendetribe will provide transaction records and audit information available on the Platform to assist, but we are not an arbitrator and will not adjudicate disputes between users.
18.2 Between you and Twendetribe
Before initiating formal proceedings, you agree to contact us at support@twendetribe.africa to attempt informal resolution. If we cannot resolve the matter within 30 days, either party may pursue formal legal proceedings.
18.3 Class action waiver
You agree to resolve disputes with Twendetribe on an individual basis and waive any right to participate in a class action or collective proceeding, to the fullest extent permitted by Kenyan law.
19. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict-of-law provisions. You consent to the exclusive jurisdiction of the courts located in Nairobi, Kenya, for any dispute arising from these Terms or your use of the Platform.
20. Changes to These Terms
We may update these Terms at any time. When we make material changes, we will notify you through the app or by email at least 14 days before the change takes effect. The “Effective” date at the top of this page reflects when the current version came into force.
Continued use of the Platform after the effective date of updated Terms constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Platform and delete your account.
